These online Terms and Conditions apply to all orders placed through our website www.elenianna.com, which is owned and operated by the company “Elenianna S.M.P.C. Company – Wholesales of Food Products and Cosmetics.” Registered office: Ispilantou 174, 18758, Keratsini, Greece.

If you use any elenianna service, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Elenianna does sell products for children, but it sells them to adults, who can purchase with a credit card or other permitted payment method. If you are under 18, you may use the elenianna services only with involvement of a parent or guardian. Alcohol listings on elenianna are intended for adults. Some of our Products have a minimum age requirement. You must be at least 18 years of age to purchase alcohol or use any site functionality related to alcohol. Elenianna reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.

1. Acceptance of terms

1.1 By using www.elenianna.com you accept and agree to these Terms and Conditions, the Privacy Policy and any other terms and policies we may post on our website, or inform you about in writing, from time to time.
1.2 The Terms and Conditions and all other policies on this website are subject to change without any prior notice. The amended Terms and Conditions or other policies will be posted on our website and will be considered binding for any purchases taking place after their publication.
1.3 The present Terms and Conditions are independent—that is to say, the annulment of one of them does not invoke the annulment of the Terms and Conditions as a whole. If any of these Terms and Conditions is held by any court or competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions, which will continue to be valid and enforceable to the fullest extent permitted by law.

2. Placing an order

2.1 Only orders placed by persons who are 18 or over will be accepted. By placing an order you certify that you are an adult according to the laws of your country or state of residence.
2.2 We will confirm receipt of your order by sending you an email to the email address you have registered with us.
2.3 Acceptance of your order means we have emailed you confirming dispatch of the items in your order. A contract is formed at that point. If some items are not mentioned in the dispatch confirmation, those items are not part of that contract.
2.4 We may not be able to accept your order if:
a. The product you have ordered is out of stock.
b. There is an error in product pricing or description.
c. Failure to meet the eligibility to order criteria set out in these Terms & Conditions.
In any such case we will notify you within 72 hours of placing your order.
2.5 Every care has been taken to ensure that descriptions, images, and specifications are accurate. Monitor display may vary; we cannot guarantee color fidelity. We may vary dimensions, specifications, and quantities without prior notice.

3. Availability

3.1 All products are subject to availability. Seasonal items may not be available at all times. Our stock is updated regularly, but shortages may occur.
3.2 Elenianna reserves the right to withdraw any product or content at any time without liability.
3.3 If you order an unavailable product, we will contact you within 72 hours to inform you of the shortage.

4. Cancelling an order

4.1 To cancel, contact us by phone or email with your order number.
4.2 Cancellation requests must arrive within 24 hours of ordering. Later requests may be accepted if the order has not yet been processed or dispatched.
4.3 If your order has been dispatched, you may return it under our Returns Policy (Section 5).
4.4 Once we accept a cancellation, we will refund the purchase price and any shipping charge; refunds may take a few days per PayPal’s policies.

5. Returns

5.1 Unwanted goods may be returned for refund or exchange if unused, in original packaging, within 14 days of delivery. Complete the online returns form and email it to us; we will issue an RMA and instructions within 72 hours.
5.2 For damaged or faulty goods, we will refund original delivery charges and item cost within 30 days of receiving your returns form.
5.3 If you receive incorrect or faulty items, notify us within 7 days and return within 14 days; we will exchange or refund upon receipt.
5.4 Return shipping costs are generally the customer’s responsibility, except for damaged, faulty or mis-supplied goods.
5.5 We recommend registered or recorded delivery for returns and retaining proof of postage.
5.6 Until items are returned, you are responsible for their safekeeping and should consider postal insurance.
5.7 For return or exchange inquiries, contact us by phone or email with your order number.

6. Payment & Customs

6.1 Payment by credit card or PayPal. Charges are processed upon or after delivery. PayPal/Stripe/Braintree secure SSL/PCI environment protects your data.
6.2 We do not store sensitive financial information. Do not send payment details by email.
6.3 Payments via PayPal/Stripe/Braintree are subject to their terms; any provider fees on refunds are borne by you.
6.4 We may only ship to your billing address or your confirmed PayPal address for fraud prevention.
6.5 We do not accept cheques or cash.
6.6 Customer is responsible for all import customs clearance, duties, taxes or other fees for shipments outside the European Union (EU). Under EU rules (including the Import One-Stop Shop – IOSS – for low-value goods), VAT is collected at point of sale; however, additional import duties may apply at destination.
6.7 If you refuse to pay any import duties, taxes, or customs fees and your shipment is returned or forfeited, we will not issue a refund for the goods, shipping, or any associated fees.

7. Pricing, VAT & Promotions

7.1 Prices are shown in Euro (€) and do not include Greek VAT at the current rate under EU Council Directive 2006/112/EC and related amendments.
7.2 You may view indicative prices in USD, GBP or other currencies; final conversion is applied by PayPal or Stripe at checkout.
7.3 Prices exclude shipping, handling, and any import duties, local taxes or VAT due at destination (if outside EU). These will be calculated and shown at checkout or applied by your local authorities.
7.4 We strive for pricing accuracy; if an error occurs, we will contact you to reconfirm or cancel your order.
7.5 Shipping, handling, and taxes do not qualify toward any minimum-purchase requirements for promotional offers.
7.6 Offer value is subject to adjustment—if items are returned, canceled, or exchanged, the value of any promotional discount will be deducted from your refund.
7.7 Discounts cannot be redeemed for cash or applied to the purchase of Elenianna Gift Cards.
7.8 Orders shipping outside Greece (GR) may not be eligible for certain promotions; additional taxes and duties may apply.
7.9 Offers cannot be combined with shipping promotions or other site-wide discounts.
7.10 All promotions may be modified or discontinued at any time without notice.

8. Delivery Information

8.1 We ship to most countries (no P.O. boxes) via DHL Express.
8.2 Orders processed within 24 hours (next working day if placed on Greek holiday/Sunday); dispatch email follows.
8.3 We aim to deliver within 30 days of order acceptance but cannot guarantee dates; if delayed, contact us.
8.4 We ship only to billing or confirmed PayPal addresses (see 6.4).
8.5 All parcels are traceable until they leave Greece; tracking in destination country depends on local postal systems.

8. Delivery Information

8.1 We can ship products to most countries worldwide. Please note that we cannot make deliveries to P.O. boxes.

8.2 All orders are delivered using the DHL Express Service (www.dhl.com). Your order will be processed within 24 hours and you can check the progress of your order by logging into your account. You will be notified when your order has been dispatched via e-mail to your registered e-mail address. If an order is placed on a Greek national holiday or Sunday, it will be processed on the following working day.

8.3 Elenianna Company makes every effort to dispatch items on time, however, we cannot guarantee specific delivery dates. In any event, the goods will be delivered to the customer no later than 30 days following acceptance of the order. If the items are not delivered within the time period we specify in the email confirming the shipment of your order, please contact us by phone on the number shown on your order invoice or by email at customerservice at elenianna.com, stating your order number.

8.4 We reserve the right to only ship orders to addresses that match the billing address of the buyer as stated by him on the online form.

If a buyer is a registered PayPal user, the purchased items will only be shipped to the confirmed PayPal address. The buyer is solely responsible for the accuracy of the data provided to PayPal.

8.5 All orders are sent via traceable postal service and a tracking number will be e-mailed to you upon request. Some countries’ postal providers do not track international parcels once they have entered their country. We regret the fact that in such cases orders will only be traceable until they leave Greece.

9. Ownership of rights

9.1 All content on our website including text, graphics, logos, button icons, images, and software, is the property of Elenianna Company (except for possible rights of the third person for which elenianna has the license for use) and is protected by Greek, European and International copyright laws.

9.2 You are permitted to use the material data and content of this website only for your personal use in placing orders through elenianna's . You may not otherwise copy, reproduce, transmit, publish, display, distribute, commercially exploit, use or create derivative works of any material data and content on the website without our prior written consent.

9.3 Any other use of our website, indicatively, but not solely, by posting, distributing, modifying or removing any of its content is prohibited without our prior written consent.

9.4 Any unauthorized attempt to defeat or circumvent Elenianna Company’s security features on this website, is strictly prohibited and will be prosecuted by Greek, European and International laws.

9.5 Establishing a link to our home page, is only allowed after our written permission, provided that this is done in a way that is fair and legal and it is not misleading or damaging to our reputation or taking advantage of it.

9.6 Establishing a link to our home page in a way that implies any form of association, approval or endorsement of Elenianna Company, without our written permission, is strictly prohibited. You must not establish a link from any website that is not owned or permanently operated by you, nor may you create a link to any part of this website other than the HOME page. Elenianna Company reserves the right to withdraw any given linking permission without prior notice.

9.7 The site is likely to offer access to websites of third people through appropriate links. The above-mentioned links have been exclusively placed for facilitating the visitors and websites to which they refer are ruled by the terms of use of those websites.
The placement of the links does not involve approval or acceptance of the content according to websites from the company. The company is by no means responsible for their content, for the methods of confidentiality protection, or the precision of the materials that exist in those websites. If the visitor of the site decides to be transferred through the link to another website of a third person, accepts that it is doing it with his/her own responsibility.
The content of the site is disposed of “as it is” and elenianna by no means provides the guarantee, positive or non-positive, related to wholeness, correctness, opportuneness, trading, non-violation or propriety of its content for any use, application, or purpose. Elenianna under no circumstances is responsible, including the case of negligence, for any form of damage the user of these websites, services, choices, and contents of the site is subjected to, to which goes with his/her own initiative and with the knowledge of the present terms. Furthermore, elenianna does not guarantee that the pages, the services, the choices, and the contents will be provided without interruption, without faults or that the faults will be corrected. Likewise, elenianna does not guarantee that this site or any other related websites or the servers through which their content is available to the disposal of the users are provided without “viruses” or any other harmful elements. The cost of the possible corrections or servings is at the visitor’s expense and under no circumstances on the company’s.

10. Disclaimer

10.1    Elenianna Company will not be deemed to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, breakdown of equipment, road traffic problems and postal service performance.

10.2 To the extent permitted by applicable law, we disclaim all warranties, expressed or implied, as to the accuracy of the information contained in any location on this website. We shall not be liable to any person for any loss or damage, direct or indirect, which may arise from the use of any of the information contained on this website.

10.3 In all cases, we reserve the right to correct any errors or omissions and to change or update the information displayed on the Elenianna Company website, at any time, without any prior notice.

11. Limitation of Liability

11.1 To the maximum extent legally permitted, our maximum liability arising out of any order placed on elenianna for the supply of goods to you will be limited to the retail price of the goods contained in that order.

11.2 To the maximum extent legally permitted, Elenianna Company is under no circumstances liable for any damage, expense or compensation arising directly or indirectly as a result of the use or delayed delivery of our products.

11.3 Although we have taken every reasonable measure, we do not guarantee that the Elenianna Company website is free from viruses or other malicious software. To the maximum extent legally permitted, Elenianna Company shall not be responsible for any loss resulting from navigating in our website or your inability of making correct use of it.
 

12. Applicable Law & Jurisdiction

12.1 The validity and performance of these Terms shall be governed exclusively by Greek laws and the parties submit to the exclusive jurisdiction of the Courts of Athens, Greece in the event of legal proceedings arising from any dispute.

12.2 The above shall not apply to the extent that the laws of the country of residence of the customer provide that another law is applicable or another jurisdiction is competent to resolve any disputes arising from the present agreement.
